Arvind Kejriwal Hearing Updates: Supreme Court Permits Delhi CM to Submit New Petition on High Court's Bail Stay in ED Case.
Mr. Kejriwal’s lawyer informed the Supreme Court that he plans to file a new petition challenging the final order of the Delhi High Court. On June 25, the High Court stayed the Chief Minister's bail, stating that the trial court had not "applied its mind" in its decision.
Delhi Chief Minister Arvind Kejriwal has withdrawn his plea from the Supreme Court, where he had challenged the Delhi High Court’s interim stay on his bail in a money laundering case linked to the now-scrapped Delhi excise policy. This development followed his recent arrest by the Central Bureau of Investigation (CBI) on allegations of corruption related to the excise policy scandal.
Senior advocate Dr. Abhishek Manu Singhvi informed a vacation Bench comprising Justices Manoj Misra and SV Bhatti that they intend to file a new plea challenging the final order issued by the High Court on June 25. The Bench granted permission for this course of action, allowing the Delhi CM to submit a fresh plea.
The High Court's Justice Sudhir Kumar Jain, on June 25, stayed the trial court’s earlier decision to grant bail to Mr. Kejriwal. Justice Jain stated that the trial court judge had not thoroughly reviewed or appreciated the full extent of the evidence presented by both parties. On June 20, Special Judge Niyay Bindu of Delhi’s Rouse Avenue Court had ordered Mr. Kejriwal’s release, noting that the Enforcement Directorate (ED) had failed to produce direct evidence connecting him to the proceeds of the alleged crime.
Justice Jain emphasized that his order should not be interpreted as an opinion on the merits of the ED's main petition against the trial court’s decision. The High Court is set to hear this matter on July 10.
Mr. Kejriwal was initially arrested by the ED on March 21, accused of being the mastermind behind the Delhi Excise policy scam. After spending several weeks in jail, the Supreme Court granted him bail on May 10 to allow him to campaign for the Lok Sabha elections. He was re-incarcerated on June 2 after the Supreme Court denied further relief.
